Welcome to Auscast Network. These Terms of Service (“Terms”) govern your access to and use of auscastnetwork.com and any related services, content and features (collectively, the “Service”) provided by Auscast Network (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the Service, you confirm that you are at least 16 years of age (or the age of majority in your jurisdiction) and that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2. Accounts and Memberships
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate, current and complete information during registration and to keep it updated.
- Memberships (including Auscast Creator+) may be subject to additional terms, fees and renewal conditions disclosed at the point of sign-up.
- We reserve the right to suspend or terminate accounts that breach these Terms.
3. User Content
You retain ownership of content you submit to the Service (“User Content”), including articles, audio, images and profile information. By submitting User Content, you grant Auscast Network a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute, broadcast and promote that content in connection with operating and marketing the Service.
You represent and warrant that you own or have all necessary rights to the User Content you submit and that it does not infringe the rights of any third party.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, defamatory, obscene, harassing or fraudulent purpose.
- Upload material that infringes intellectual property, privacy or publicity rights.
- Distribute viruses, malware or any code intended to disrupt the Service.
- Attempt to gain unauthorised access to the Service, other accounts or related systems.
- Scrape, harvest or otherwise collect information about other users without consent.
- Impersonate any person or entity or misrepresent your affiliation.
5. Sponsorship and Advertising
Sponsorship, advertising and partnership arrangements are subject to separate written agreements. Bookings made through the Site are not confirmed until accepted by Auscast Network in writing.
6. Payments and Refunds
Where the Service includes paid features (such as memberships or advertising), payments are processed via third-party providers. Fees are non-refundable except where required by law or expressly stated. You are responsible for all applicable taxes.
7. Intellectual Property
All content provided by Auscast Network — including the Site design, logos, trademarks, text, graphics, and software — is owned by or licensed to us and protected by copyright and other laws. You may not copy, modify, distribute or create derivative works without our prior written consent.
8. Third-Party Services
The Service may integrate with or link to third-party platforms. We are not responsible for the content, policies or practices of third parties, and your use of those services is at your own risk and subject to their terms.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Auscast Network and its officers, employees and agents will not be liable for any indirect, incidental, consequential, special or exemplary damages arising from or related to your use of the Service. Our total aggregate liability is limited to the amount you have paid to us (if any) in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Auscast Network from any claims, damages, losses or expenses (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for breach of these Terms. Upon termination, the provisions which by their nature should survive will continue to apply.
13. Governing Law
These Terms are governed by the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any disputes.
14. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted with a new Effective Date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
